In Azerbaijan, a mother involved her underage daughter in prostitution

Statistics show that a significant number of serious crimes are committed by people from the victim's immediate circle. News feeds regularly feature headlines about domestic violence: "Father killed son", "Brother stabbed sister" and similar tragedies.
This week, the public was shocked by information that in the Yardymli district, law enforcement agencies stopped the criminal activities of a group of four people, including the mother of a minor girl. The suspects are accused of sexual violence and involving an 8th-grade student in prostitution.
According to the press service of the Ministry of Internal Affairs of Azerbaijan, investigative actions on the initiated criminal case are currently ongoing. All four suspects are in custody.
This case raises an important legal question: does the legislation provide for special responsibility for parents who involve their own children in prostitution?
According to lawyer Ruslan Mustafayev, the current legislation does not specify separate responsibility for involving one's own or someone else's child in prostitution.
"The Criminal Code has a corresponding article about involvement in prostitution. However, there are certain circumstances that should be considered as aggravating factors. If the crime is committed against a minor, using a person's helpless state, with blackmail, threats, intimidation, or by a group of people by prior conspiracy – this, naturally, is considered as aggravating circumstances and leads to more severe punishment," he noted.
The lawyer emphasized that the judge has the right to impose a more severe punishment, taking into account the moral aspect of the crime.
"The judge reviewing the case imposes punishment, also evaluating the moral aspects. Because he passes sentence guided by the legislation of the Republic of Azerbaijan, as well as by his inner convictions. That is, the judge can decide to impose a more severe punishment on a parent who committed a crime against their own child," the lawyer added.
