Restrictions related to the receipt of gifts by officials and the use of simple hospitality are being established.
As reported by BAKU.WS with reference to Oxu.Az, this issue is reflected in the draft law "On Conflict of Interest."
According to the draft, restrictions related to the receipt of gifts and the use of simple hospitality are established by Article 8 of the Law of the Republic of Azerbaijan "On Combating Corruption."
Within three working days after receiving a gift or simple hospitality, an official shall report to the authorized entities information about the name, type, characteristics, value, purpose of presentation, date, time, place of the gift (simple hospitality), and the entity that presented it, as well as submit evidence confirming this information.
If the designated entities identify signs of violation of the provisions of the legislation on the prevention of conflict of interest, they may request the given gift for evaluation. In this case, the official shall present the given gift for evaluation.
Authorized entities shall maintain records of gifts or simple hospitality, and upon establishing a violation of the requirements of the legislation on the prevention of conflict of interest, shall take measures in accordance with this law. If the acceptance of a gift or simple hospitality leads to a conflict of interest, the authorized entities shall make a decision to return the gift, and if this is not possible, to transfer it to the balance sheet of the institution.
If an official experiences difficulties in accepting a gift or simple hospitality, or considers that the gift or simple hospitality leads to a conflict of interest, the official shall obtain confidential consultation in accordance with Article 22 of this law.
