MMA pop fighter Shovkhal Churchaev could face severe punishment for beating Azerbaijani blogger Subo (Subkhan Mamedov) during a livestream in Dubai.
Criminal defense attorney Maxim Silvestri (Kalinov) told gazeta.ru about this.
"In Dubai, they take many measures regarding public safety. And according to their legislation, bodily harm and insults in public places or at work can result in large fines and prison terms. Here, the blogger was probably caused serious bodily harm. By analogy with Russian legislation, in Dubai, serious injuries are considered those that resulted in disability for more than 20 days. In Russia, moderate severity is qualified under Article 112 of the Criminal Code of the Russian Federation, where disability lasts 21 days - a minimal difference.
But there, it carries a large fine and punishment of up to five years imprisonment. Also, Dubai legislation is in many ways similar to American law in the sense that each emirate, like each US state, has its own laws. And if the case goes to court, it will be taken into account in which emirate the crime was committed, what kind of person committed it, whether they are a citizen of the country. Deportation, entry ban, and other legal consequences may be threatened.
If, for example, the beating had occurred on board a Russian aircraft in Dubai, then the case would have been considered in Russia under our Criminal Code. Because crimes on an aircraft or ship of our country are considered violations on the territory of the Russian Federation.
The consequences for the MMA fighter will possibly be serious. It depends on how his defense will act. But in Dubai, they monitor public safety very strictly. And, as I said, even an insult on the street can lead to a year in prison and a large fine," said Silvestri.
