In Azerbaijan, these individuals will receive hourly wages
The amount of payment for services and other expenses related to the provision of free legal aid is being determined.
As reported by Oxu.Az, this issue is reflected in the law "On Free Legal Aid," which was put forward for discussion at today's session of the Milli Majlis Committee on Legal Policy and State Building.
According to the draft, the payment for professional legal aid services is set at 0.0275 times the minimum monthly wage for each working hour, and the payment for primary legal aid services is set at 0.015 times the minimum monthly wage for each legal service provided.
For additional expenses related to the provision of free legal aid (stationery, postal, communication, transportation, and other expenses), a surcharge of five percent of the specified payment will be added to the service payment determined in accordance with the relevant article of this law.
The payment for services of lawyers engaged in providing professional legal aid on weekends, voting days, non-working holidays, and the day of national mourning, as well as during nighttime, shall be paid at double the amount established in accordance with the law for each working hour, while the amount of the surcharge for additional expenses paid in accordance with the relevant article of this law remains unchanged.
The procedure for payment of services and other expenses of persons providing free legal aid is determined by the body (institution) established by the relevant executive authority.
Persons who have provided free legal aid shall apply to the Bar Association (BA) in the established procedure to receive payment for services and other expenses related to the provision of legal aid from state budget funds.
The Bar Association shall make payments related to the provision of free legal aid to persons providing free legal aid (except for persons providing legal services pro bono), based on reports provided for by the relevant article of this law.
In cases where the submitted reports do not comply with the form established by the relevant article of this law, or if the said reports reveal a violation of the requirements established by this law in connection with the provision of free legal aid, the Bar Association shall not make payment for the provision of free legal aid.
Persons violating the requirements of this law shall bear liability in cases established by law.
